As far as I know all '09 Touring models were equipped with TBW. I've heard some have had bad experiences with some of the '08 versions but my '09 FLHX has performed flawlessly over the first 10K miles...

TBW has been around for years in cars and it works fine. There is nothing wrong with it in the 08s. Some people have inadvertently set their idle high or inadvertently hit cruise control "resume" and it scares the crap out of them so they try to blame it on a defect in TBW.
