Yes I understand about over revving and actually losing power at a higher RPM. My 07 night Train with a stage 1 kit and D&D fat cat 2 into 1 pipe pulled all the way on the dyno to 6100 rpm. my new 09 bagger seems to poop out just after 5600 rpm

If you don't plan on doing anything else to the bike (i.e. tuner and AC), the Stage 1 download would be the only way to increase the limiter. OTOH, like some have already said, without opening up the intake I don't think the revs will be there in a practical sense that would provide better performance. The HP curve for a stock '09 setup starts dropping off at about 5000 RPM. Based on a dyno chart I've seen it drops about 5HP from 5000rpm to the stock redline (~5600 IIRC).
If you're going to spend $125-150 for the download you should also install the SE AC, which will help performance noticeably and should allow the engine to breath freer and open-up the top-end more.
