Finally took the bike back to the dealer to look at the tire. I have 8K miles on it with noticable cupping. They took measurements of the tread, pictures, checked air pressure, and sent it all off to the MoCo. MoCo asked for service receipts since the dealership had nothing (do my own service). Faxed everything to the dealer, now we'll wait. Just adding this information since after reading all the previous threads, I haven't seen this particular tactic before. The company's response to various owners has been all over the charts. Like someone mentioned, it seems to be based on who answers the phone. I'll update when I hear back.

Why would they need your service records??? What does that have to do with your front tire? Did I miss the part of the service schedule where it says you have to change the air in the tires every 5000 miles?
One thing for sure ya gotta do, whine about the steering shaking and not the cupping thing. Thats the way or reason HD has been taking to replace the tire.
called cust. service wed. and asked if they had any issues with vibration and they gave me a claim number and told me to go to dealer. haven't had a chance to set up appt.yet but plan on it this week....will advise
Just got a call from the dealer (High Desert, Meridian Idaho). MoCo will be replacing the tire with a 408 at no change. Kinda restores my faith in the system.
