I just bought a 2009 RG CVO seat to install on my 2010 RG Custom and the seats are definitely different; that is with the rear thumb-screw installed, there is about a 1 1/2" gap between the nose of the seat and the gas tank. I you pull up 2009 RG CVO's on ebay you will note that this apparent on some, not all, of the bikes shown for sale. Weird, but true.
What I did was buy an adjustable rear tab (#51699-09) from the dealer ($16) and replaced the original CVO rear tab with the adjustable variety which is longer.
You will note that the adjustable version is flat, where as the original has two bends. Simply use a bench vice to replicate the bends and the seat will fit like a glove. It is a great looking seat, sits about 1" lower than stock and is MUCH more confortable for the passenger that the stock RG seat.
I thought the 2009 RG seat (and CVO RG seat) with the HD drivers back rest did not fit great at all, way too tall for my comfort and looks, cause the seat sits very low compared to the EG seat... I ended up buying the Utopia Drivers backrest that is much lower / closer tho the seat. Just my preferrence ... mounts just like the HD one ... on rear fender through the slot in the seat ... and costs less
