The systems are the same...controller, rotors, pads and other components. The 2008 has a different calibration than the 2009 and later models. This is because the frames and tires/wheels changed in 2009. The 2008 though does have an upgraded calibration specifically for the 2008 system.

The 2009 and up calibrations are like this. New Calibration for 2009 and then the 2010 came out. The 2010 had a newer calibration than the 2009 but it is upgradeable back to the 2009. 2011 is the same as 2010. The 2009 and 2010 calibrations are not upgradeable back to the 2008 because of the reasons I listed.

Make sense?

Almost makes sense, I understand the reasons, due to frame and other changes, making the 2009+ models have a newwer calibration. As for the 2009 to 2011 changes I'm a bit confused.

Can, if there is any improvement in newer models, the 2009 calibration be upgraded?

You have to stop, shutdown and restart the bike when you want ABS. Unfortunately you cant turn it off and on whilst on the fly, it needs to be stationary to do its start up checks.

The 09 can be updated, mine has and its better. But as I said dont expect BMW quality.
