I have only had 1 encounter with a cage and it was when I was on an atv. The guy turned right infront of me, no blinker, no nothing. I T boned him since I could nto stop or find a way to get around him. I smashed in the right box side and side of the cab then catapulted over the bars and smashed out the rear window of the pickup with my head and bent out the left box side of his pickup with my body and ended up on the curb on the otherside of his pickup. Minor bumpes and bruises and was a little dizzy since I did not have a brain bucket on.
But this was a great lesson for me. I drive my scooter like people are trying to take me out at every intersection. I never pull along side anyone unless they are stopped or more then halfway into their turn.
Heck a couple years ago, one of our semi drivers was following a farm truck. The truck had his right blinker on and started to slow down. Our driver pulled out to go around him and the farm truck turned left right in front of our driver. All said and done, there was a semi and a farm truck stuck together in the ditch that day. No one killed or even hurt.
Sorry to hear about the accident, at least you are still with us, could have gone bad real fast. Hope you have a full & speedy recovery. Since I had my accident many friends have told me to stay strong and be positive, good advice.
So I am telling you the same, stay strong and be positive.
I am still recovering from a similar accident back in May. I just had my second surgery on my leg "Tibia will not heal."
Only advice I have for you is think long and hard about weather or not to get an attorney involved. If you do get one, and the person that hit you only has limited insurance you'll loose 33.3% of what is probably not enough any way. If the police report shows the cager at fault, his insurance company will be quick to respond with a reasonable settlement once your statement of charges comes in from the hospital "probably whatever his max bodily injury limits are" Since your medical bills will probably be in excess of $200,000 by the time it is over, you'll likely have a much larger claim than what his insurance can pay for.
Alot of people would then say "I'll just sue him personally." The problem with that is the lawyer gets 1/3 off the top, and collecting on a judgement is nearly impossible in most situations. Going this route will also delay you getting ANYTHING from the cagers insurance for bodily injury until the judgement is settled which typically will take 1-3 years.
None of this will affect your property damage claim though, you should be able to settle that in a few weeks on your own. Just know the first offer is just that "an offer" I negotiated my offer from $15,000.00 to $19,750.00 just be being firm with the adjuster on what I was willing to take. They want the claim to close quickly, so they'll usually give you a little more than thier first offer just to be done with it.
Also don't forget to review all your insurance policies for ALL vehicles of persons living in your house "including yourself" that are either your spouse or blood relatives. Medpay, and underinsured coverage quite possibly can be collected from those policies even though they may be from different insurance companies than your bike insurance.
Unfortunately for me, I have spent the last 7 months educating myself on NC Insurance law to be sure I am getting everything I can.
