Well if he was that drunk, then maybe he didn't "knowingly" take the wrong bike. But it does still sound that an unauthorized use charge would fit.
That being said, I still think there are a lot of FACTS missing from this story. I can't believe a brother would let a drunk ride away, but I guess ya never know.

I joined the forum back in 07 and never once thought of increasing my post.But hey you are allowed to see it your way,I did at my own free will come here and post my shitty weekend.So I understand if some dont believe a word,you are entitled to your opinion.But those of you that flat out say something like this connot happen,I can only say sorry to offend you with what happened to me.I probably struck a nerve seeing that these guys are or were former cops,either way it is what it is.If you wjsh to continue to follow this thread fine,and if its BS then go to the next one.I really wouldnt give a ........
1) Police are corrupt and covering for a buddy. If so, the police report obtained would either corroborate the findings or be a falsified report
2) Parts of the story are missing
3) The OP was drunk and things happened differently then stated
4) The OP is not telling the truth
5) I need to buy reading glasses
Knowing how things are here in the Valley, I can totally believe this story. I'm just glad you got your bike back. Personally, I'd tell SPIPD that you want to file Unauthorized Use of a Motor Vehicle charges on the guy and let the DA's Office sort it out. If you don't get any satisfaction with the PD go directly to the DA's Office.
There suspect there is more to this, then we know. Either way, No way would i let it slide. I'd want charges laid and damages taken care of.
Cop needs to be charged with something here.....one, for letting the drunk ride off and two, for not even at least charging him for property damage , but should also be charged with theft. As others said...see the chief of police, the prosecutor and if need be a lawyer.
at the very least he damaged your bike . go to a higher rank.............or there must be a way to make a formal complaint.act quickly,everyday that goes by weakens your case......google and do a complete check on this guy.Hopefully he sees what he did and pays the damages.Personally why didi they go in the bar to find this guy and then do nothing when they found him. the cops could have easily said here's your bike........something isn't kosher.....
