I think it's definitely time to contact the local DA for consumer fraud...
For what it's worth..... I was in the industry for 15 years, and I was a selling dealer for their product line (mostly wheels). I went thru this bullshit with Wicked Image time after time after time. Orders shipped one piece at a time, sometimes taking up to a year to get the complete order, only to discover flaws and mistakes, Nothing more than crooks in my opinion.
i heard that they had hired chuck ruiz to give them tips on "deluxing" customers...seems that they learned well.
now that you have an e-mail stating that your credit card could not have been charged and it has indeed been charged, there is a chance that a district attorney would look at this as criminal fraud. cetainly worth contacting the authorities.
