As you may correctly surmise, I copied and pasted the data directly from my pdf manual. My 2014 Softail owners manual (same sort of little book you show) says simply 32 oz. with no reference to the 40oz dry. Dunno why Touring and Softail manuals would be different but it seems they are.

38oz according to the manufacturer for a simple drain and fill.
