I can't add anything of mechanical value to this conversation but I don't think you have to worry about the warranty running out. The dealer has been trying to get it fixed and it is documented in the system. If the problem still exists when the warranty ends it it usually treated like it is still covered.
Either way, hope you get it resolved soon.
I know this is an older thread, but I have this same exact issue on my 09 Fat Bob. It started after about 20k, oddly enough when I had a Baker Compensator put in. I don't think it is related to the comp, just coincidence. So far I have triple checked the alignment of the comp to clutch, replaced clutch plates, tried 4 different fluids, 4 or 5 different adjustment methods, and the issue remains.
My guess is it is likely the dogs rounding out as previously mentioned. It is horribly annoying, hopefully I can track it down soon. Next step is to try and adjustable shift linkage.

I tried everything including letting the dealer test ride and check out everything. His mechanics rode the bike and had no problem with it keeping on falling into neutral when shifting to second. They said it may be to my thick- Harley brand boot. But I had been using the same boot for nearly a year before my neutral problem.Baker chimed in and said it may be the dogs.
In any case , I noticed that there was a slight hesitation as I pulled in the clutch. So I lubricated the hell out of it and about 50-75% of the problem went away. I still have the problem, but I can go several days without it happening. I also make sure I get my boot toe under the shifter . I have learned to live with it with no problem.
The good thing is I have no problem getting the bike into neutral at a light or when I stop. I never could say that about a Harley before.
Learning to live with it. Probably most everyone one is right. Rider, dogs, detents , etc. In any case I went on a 5 day trip , including the curvey Big Sur and had no problems. Bike ran great. I appreciate all the help and responces. That is what a forum is supposed to be.

Same issue with 09 FXD. Never had a shifting issue since purchased new then it started this summer occasionally, thought it was operator head space and timing but it has gotten progressively more frequent. I use the same shoes and started paying more attention to my "***** Foot" which does not appear to be the issue. Two things have changed:
1. Switched from Forwards to modified mids
2. Started using Amsoil in all three holes.
Same issue with 09 FXD. Never had a shifting issue since purchased new then it started this summer occasionally, thought it was operator head space and timing but it has gotten progressively more frequent. I use the same shoes and started paying more attention to my "***** Foot" which does not appear to be the issue. Two things have changed:
1. Switched from Forwards to modified mids
2. Started using Amsoil in all three holes.
I also switched from forwards to mids on my 2013 SB. Never had the problem with forwards. The dealer replaced the shifter lever and shifter rod- must be level- in an effort to resolve my problem.
I reciently started using Amsoil specific formulas for all three holes, but this problem was well before.
What did help, out of desparation, was to lubricate the hell out of the clutch cable( I had noticed a little bump when engaging or releasing). I still get an occasional neutral , but only once a week or so. Its now about a year and I am very satisfied, both with mid controls and the easiest Harley to get into neutral I ever had. You figure. Also ask me how I got rid of the click in the stering head when going over a small bump( 6 months so far).

My Clutch is pretty smooth, got better when I switched to Amsoil. Going take it in and see what they can figure out. I like riding more than wrenching.
