Have done it before and its better. Now I use a catch can, better yet.
If the vent system is working properly and routed up to a catch system I would think I would get just as filthy as routed down.

Think of the Harley motor as a very big air pump. Even with zero blow by (ring leakage) the pistons are moving a large amount of air up thru the top end and pulled back to the bottom end with every stroke.

if you are putting enough oil out of a "to the atmosphere" vent onto the road to make it slippery, you have other issues.

Most of it is vapor, which condenses back into liquid, and the liquid goes down hill!
I only speak from experience, and what works for me.

x2 - I had a filter clog up under the frame there and burst the lines off the T fitting. Filter under the AC cover just put oil on the side of the bike and my pant leg. No more filters on any of my bikes. Catch can is a nice alternative solution that I may incorporate one day if needed.

Yes gravity but also a potential column of oil in the vertical tubes creates positive pressure.

Open line, just stick your finger under tube while she's warming up, should be air and a little condensation coming out.
If it's blowing oil, go to step 2.

I'm running my fitting up, not down. Breather hose routs under the tank & seat and exits at the swingarm. NO FILTER/CATCH-CAN NEEDED.

Just got the breather/catch in and connected, spiffy little thing! I was thinking of making something myself but I certainly couldn't have come up with something of this quality!

While I do understand your logic, it will never have a column of oil in it, and if it does, you got other problems.
From many different bikes I've had:
I have had them in the AC, and oil always drips at the bottom.
I have had them down to the little filters, and they get wet and drip.
I have had a hose down to the ground, it drips.
Now I have it go up, then down to a catch can, which I empty a little out at oil changes. So far my favorite.
