You explained it perfectly! It feels like it's in first and the shifter won't go down any further. I try to downshift all the time instead of braking but still when I stop I think I'm in first and let out the clutch only to find it's second. Glad to hear I'm not alone. Now what to do about it.
I don't have the problem as described by the original post but sometimes if I downshift while rolling (clutch in) i get a chatter sound from 2nd to 1st. I back off and wait until I'm almost completely stopped to shift into first. It always works if I'm stopped or going less than 10 mph. Why the chatter?

Do you have forward controls or mid? I was wondering in the problem is in the forward control linkage.
Asked dealer to look at it when they did the 1k service and they claim they couldn't find any thing(wrong)

I have mids and my FXDI is bone stock w/4500 mi. Jandlcars, no rocks in fifth. All other gears seem fine and shifting in upper gears getting smoother with time. Aren't first and secon square cut and three through six helical on the 06 Six Speed? Maybe thats why uppers are smoother. I too have started off in second and after the initial roll kicked it down to second but I shouldn't have to do this. In the big picture this is a minor annoyance but it still sucks when you pay so much for a bike.
not sure if forward controlls are the prob or not.looked at linkage whole assembly moves together so thinking its tranny here.wait till if you atart experinacing going dwn the rd with power on and it seems locked the shifter till u left off then try again and thenslips into say 4th 5th or 6th.happening once in a great while it is.and no its not because of load on the gears.its the gremlins in the 6 speed i am afraid.bike currently has 16500 on it

Well,so much for that theory, my ride is also born stock other than the forwards and pillon seat w/tall sissy bar..oh well.. it must be inside tranny .. The money's one thing but pulling out into traffic and not being in the correct gear is a bigger concern to me.Could be deadly -Jersey drivers aren't all that forgiving (lol)
