Glad your OK but it sounds like it's your fault for passing unless the road's center lines gives you the right away to pass at some point , i think you should have waited to see what this guy was braking for , turns out to take a turn without his blinker , the truck made it and not you , I hope everything works out for you in the end , Safety First !!

Let me start by saying that I'm not chastening you as you didn't have enough information to make an accurate assessment.

I agree I should have waited to see what the other drivers intention was before proceeding, shoot he was only approximately 50-75 feet from his intended turn. And I didn't see any indication of him wanting to turn only brake lights. When should he have indicated that he was wanting to make a turn? It was a passing zone that I was in.

I have others telling me I should it's not my way. I was wanting to know from others on this forum that can relate to the sitution as most of the advice is not comming from fellow bikers.

Certainly those of us that have been driving for twenty years would know that clearly showing your intentions to other drivers is not only the safe way of doing it but also the right way.

Good to see you made it, I totaled a 68 Bonneville and walked away too but it sux when it's not your fault...........don't know about a lawyer but it might not be a bad idea to get councel with one. Good luck with the new bike

glad to hear your ok"ish" and i would get a lawyer at least to represent you if it goes further than an insurance claim and if the driver or your insurance company wants to fight it

If they are totaling the bike and you are happy with the amount of money they offer I don't think you need a lawyer. If you are not happy with the money or there are injuries and other payments involved I would get a lawyer for sure. Learned this the hard way.

Not sure about the traffic laws in SC, but if you were not cited for traffic infraction, you might have a chance of reducing fault. Most personal accident attorneys will work on a contingency. a case like this is so unpredictable, i doubt you will find one with out a retainer up front... The best you could probably hope for is that each driver/rider would be found to be partially at fault, and each assigned to be responsible for their own damages... unless you have a witness, your chance of proving the driver at fault is about zero. if it went to trial, it could cost you several thousand dollars ( for a good attorney with a chance of winning ), unless you have a lot of medical bills that are not covered, i doubt the potential for return is worth the risk...

I read an article recently about the percentage of drivers who are too F'N LAZY to use their damn turn signals. It's like 70% or something like that. Drives me nuts! But that's just another of the many reasons not to trust anybody.

But, yeah, if I see brake lights and it's not clear why they're slowing down, I back off and wait. Call me chickenshit, I don't care. Survived almost 40 years...

Glad you're still in one piece.
