Forking wrecked my Fat Bob
I'm not trying to pass the blame here, I'm not sure of the laws but have been told that in SC in a passing zone the driver needs to make sure that its is clear to make said turn in either front or from passing vehicles before turning regardless of turn signal or not. But I'm unsure of this as of now it looks like my insurance will have to pay for all damages. I just think that if this law is correct that he should at least pay for his damages and I pay for mine. Seems fair enough to me. Not looking for a big pay-out here just want what is fair. I'll talk to my insurance about this but haven't been able to reach him today.
Yesterday I was contacted my my adjuster with a total his offer was 14,029.00 that's with my deductiable taken out for a 2010 Fat Bob 12,789 miles I asked for a breakdown of the accessories and he didn't have them all. Still need to work out the details but seems to be in the right ball park.
No guardian bell not a superstitious type. And if I'm not mistaken in order for the bell to work it needs to be given to you. So I didn't have one.
But, yeah, if I see brake lights and it's not clear why they're slowing down, I back off and wait. Call me chickenshit, I don't care. Survived almost 40 years...
Glad you're still in one piece.
if the law states that the driver has to make sure that it is clear to his left, it would make him at least partially responsible.
$14,000 for your 2010 fat bob is pretty good... i paid $13,000 for my 2011 last november with 6,000 miles on it... bone stock...
Good luck with what ever you decide to do, glad your ok and will be able to ride again soon...

Not to beat on you.....but this is exactly why I stay completely away from cars.
They didn't mean to hit you......this kind of thing just happens....so I avoid the "chance" by speeding up or slowing down to get away from all cars.
Sounds like a PITA, but after awhile, you do it without even thinking about it.

- Research the applicable state law for passing. Come to a conlusion of what a realistic outcome should be
- Work with your insurance to see how that works out
- Don't say more than you need to your own insurance co. Don't answer ANY questions to the other guys insurance, just tell him to talk to your insurance co. Don't let them see the bike/get picutres unless your insurance co tells you to
- Lawyer up if you believe the outcome was unfair
My uneducated opinion is this will resovle as 50/50.

It's unfortunate that we live in a litigious society, but if you try something legal without a statement of fault then the only winners will be the attorney's and insurance companies.
