I guess I'm going to have to prove the issue to them. From the sounds of it, they are blowing me off. Thank you guys. I really do appreciate the help . There's a lot about these machines (and dealers) I don't know and I am glad you guys do. I guess all I can do right now is monitor the fluids, document it, and then be there when the fluids are drained when I take it back. Does that sounds like the best approach at this point to you all.
May not be blowing you off as much as they may not have a clue as how to find out what's wrong. The fact that they told you to come back for a recheck in 1000 miles does show some incentive to help you. Like has been said before, it matters to you more than anyone else in the world because it's your bike. Keep on it. If they show signs of incompetence then find another dealer, any dealer can perform warranty repairs.
If the shop does understand that the primary was getting filled with engine oil, they probably need to go through a process to get warranty approval, that is why they said bring it back in 1000 miles.

I'm learning a lot from this. Thank you all. I will stay on top of it and do what I know to do. Thank you Fat11Lo for bringing to light about showing incentive telling me to bring it back. The mechanic did say I have an open warranty claim with MoCo for this. That sounds like a good thing. I know a lot times, it's too easy to just get aggrevated, but I think keeping a cooler head will prevail on this, it certainly won't hurt.

I would make sure they took the outer primary case off and inspected and then documented the fill numbers of SYN 3 in all 3 holes
I would use SYN 3 in all 3 holes for this experiment
(like 38 oz in primary
4 1/2 quarts in motor
quart in trans)
Documented
ride 200-300 miles and check the level in all three
ride 300 more miles and check again
and again at 300 more
and then take to dealer to check at 1000 miles
easy enough to do
you will see a fluctuation by the second check if something is bad wrong

Thank you 94 Ultra. They told me they did have all levels topped off. I checked it and it was one bar down from full when I got it home. Didn't check it myself before I left the dealership with it yesterday so not positive if it was at the top mark prior. So I will check from here and use that as my guide. I didn't get time to ride this morning but hopefully will this evening.
Just wanted to get back with everyone and let them know the results. I rode the bike the 1000 miles they asked me to do. It took a little longer than that usually would as I was sick for a few weeks. The bike did continue to loose oil (dropped almost 4 dots on the dipstick) and I took it back in. They told me they had to replace the crank seal and checked everything else in the primary and it was ok. I still have the whining sound, which I thought they would loosen the tensioner and help solve that. I want to thank all of you for helping me with this. I am still hesitant that has been corrected due to what they originally told me and the end result, but I hope it is. I am going to continue to watch the oil level. I am also thinking of later changing out the auto tensioner with the Baker attitude chain adjuster but not sure I want to mess with anything right yet. Again, thank you for al of your time and assistance with this.
