I'm so confused now. Your picture is different to another one a couple of pages back in this thread.

Your pic shows very bottom of clutch basket

The other pic shows bottom of diaphragm Spring which is slightly higher.

What year is your bike? I have the 1997 1998 manual at home and I'll upload the pages I think you're a 1997 right? Don't do anything yet let me get you the pages so you can see it

97 dyna 32oz is fine maybe you measured wrong. Here's the right picture I believe your 96 is the same as a 97

just want to be sure, dont want to damage anything and this is all new to me , deffo 39.6 oz in there for sure.

Interestingly my haines although not a great manual says fluid capacity is 38-44 us oz..

Your level is close to perfect. If you would refer back to post 12, I stated that these measurements were approximate. The MoCo couldn't even print an exact number. If you let the primary fluid drain overnight, it will take more fluid. That has been my experience anyway.

Like other's have posted: Button it up and ride it.

Man you could fill all the way to the edge of the derby cover and you wouldn't hurt anything, make it hard to shift maybe but it wouldn't hurt anything.

As mentioned above you are fine!!!!!!!!!!!!!!!!!!!!!!!!!!
Put the derby cover on and ride.
