I wouldn't dispute that; my point was simply that for something to constitute first-degree murder, there generally has to be provable pre-meditation. This woman's actions fall in the area of gross negligence or reckless disregard for human life, but not premeditated killing.
As I noted above, I agree her actions warrant severe sanction.
Drinking and driving/riding is a premeditated act. Its consequences are easily tangible.

As a matter of fact, I think being caught while driving under the influence should be an automatic charge a attempted negligent homicide. If in ANY form of accident it gets bumped to attempted 2nd degree murder.
No. Accidents happen, and most of the time its more one party's fault, but drunk, unlicensed, and going 115. Then fleeing? That's criminal on multiple levels. F her and her whole family. Hope she dies in jail.

I hope the charges were "Stacked" to the maximum. And the District Attorney for that area of N.C. presses for "consecutive" sentences rather than concurrent. AT least this way she will be locked up for a very long time even though someone posted earlier the max sentence was 74 months there in N.C. Consecutive sentences can keep you behind bars for many years. That's why "thugs always plead guilty for concurrent time instead. She's a "thug" too except she used a vehicle as a deadly weapon IMO rot in jail B*t*h...
Yeah, but she won't be behind you anymore. In addition to second degree murder charge earlier today, they also charged her with Felony Death by motor vehicle. An example maybe? I hope so.
