Another Update. She now also faces up to 23 yrs for the multitude of charges against her. It is her 3rd DUI, the 2nd is still pending in a neighboring county (Chatham,) and guess what she does for a living? She's a bartender. (The bar she works for claims that she wasn't working that night.)
In my opinion, driving/riding while intoxicated is a willful disregard for human life.
I wouldn't dispute that; my point was simply that for something to constitute first-degree murder, there generally has to be provable pre-meditation. This woman's actions fall in the area of gross negligence or reckless disregard for human life, but not premeditated killing.

If this turns out to be true, her defense will be she drank at home after the incident and was sober at the time of the collision.

(This isn't me being clever...just been researching the definition of murder, murder in the first degree, and so forth.)
I can see the logic of a 2nd degree murder change in this case, if they could prove the facts as we understand them. But, it's an uphill battle, as you have already observed.
My sons who are both LEO's say the average people wouldn't believe how many people are driving on Expired License, without insurance.. and/or who have warrants out on them..
Its over 50% of those who they stop.
Oddly,, most speeders are Females and they both say young Females gets 75% of the tickets they write.... and both say the young girls and women think they can talk their way out of a ticket or any other charges...
And I wonder why the Boys still Pay 2X the amount on insurance Premiums that Girls do even without a ticket as girls with 1-2-3 tickets...... Thats --- BS.
We can tear her to shreds, torture her, whatever...it'll only make you feel better for a week or so, until another one is in the news. The world is full of people like her and this sort of thing happens often.
And all those morons wasting my good air and killing innocent people need to be lined up against the wall and ended. Simple and useful for the nation, lives saved in the future and cleaning up the gene pool and air. Plus, all those buried bodies makes for good fertilizer.
