Not that it makes a difference, but on the nightly news here last night they said she was trying to get around him, and every time she changed lanes, he would too, preventing her from passing. Looks like classic road rage to me, I'm interested in seeing how it all turns out.

Im not a lawyer but I play one on TV......really...I am a licensed gun dealer and have a CCW in NY also. Theres something called Disparity of force here in play. The bike rider does not need to be armed for the woman to be justified in shooting him. She really did not let it go far enough to invoke that IMO however. She needed to take at least one in the face if that would've happened before taking him down. That shows showed restrint up to being actually assualted. Now she " thought" he was going to hit her. If he had a pipe or a knife, yes, take him pre-assault. But if hes just got hands you have to take one before you can put him on the hood of your car....

Keep in mind that "Disparity of Force", can be a very real defense in many cases of the use of deadly force.

The Use of Deadly Force
To the unprepared, the shock of sudden and unprovoked violence has a tendency to paralyze the victim with fear or cause doubt in their mind that violence is being committed against them.&nbsp\\; They are often unable to react or wish it was not happening.&nbsp\\; Understand that you fight to stop, not to kill.&nbsp\\; However, you may end up killing or maiming.&nbsp\\;If you have not made peace, in advance, with that decision, you may not be able to make that decision when you need to.&nbsp\\; Should you ever find yourself in a lethal confrontation\\; the decision to use deadly force is going to be yours and yours alone.&nbsp\\;
This why you must decide ahead of time how much force you are willing to use to defend yourself, your loved ones, or another innocent.&nbsp\\;
&nbsp\\;You are universally justified in the use of deadly force when there is a reasonable fear of immediate or otherwise unavoidable danger of death or serious bodily injury to the innocent.&nbsp\\; All of these factors must be present to justify the use of deadly force.&nbsp\\; If one of them is missing, you will most certainly face civil and maybe even criminal charges.&nbsp\\;
You or the person you are defending must be free from fault.&nbsp\\; In other words, you can not start a fight then claim self defense.&nbsp\\;
You know when you are in immediate and unavoidable danger when your assailant has the ability to cause harm, has the opportunity to inflict harm, and is intent, as shown by actions or words, on killing, crippling, or permanently disfiguring you.&nbsp\\;
&nbsp\\;"Lethal force is justified when there is a disparity of force such as:"
A large man against a small man
Able bodied against disabled
Man against woman
Two or more on one
Someone trained in martial arts against an untrained person
When do you retreat?
In order to justify the use of deadly force, you must show that there was not an alternative.&nbsp\\;&nbsp\\; In some jurisdictions, retreat is required.&nbsp\\; If you do not retreat until you could retreat no further, then you are not justified in the use of deadly force.&nbsp\\; In the universally accepted use of deadly force, retreat is always a good idea and should be done if it is a viable alternative and does not place you or those around you in greater danger.&nbsp\\; Retreat will establish that you did everything possible to avoid the confrontation.&nbsp\\;
Always keep in mind:&nbsp\\; if it’s not worth dying for it is not worth fighting for.&nbsp\\; If you must think about fighting, you probably should

HMMM...thats a hard one.&nbsp\\; Here in WV It's best for the shooter if the other person is armed, or in her bedroom, BUT she may be able to get away with it if she is pretty small, him pretty large and they can prove he had intent to mame/Injure/kill.&nbsp\\; Therefore her lawyers can argue that she had reason to believe her life was being threatened.

Personally, sounds like she overreacted.&nbsp\\; Like others, I'm interested to know how this pans out...

I would still like to know the size of these two. Was he hugh/small. Was she hugh/small. No details of that yet. Yalanda, that name sound to me like someone in a hurry getting to the food store to buy out all the twinkies. The bitch shot him. WTF

Let's look at this in a different perspective:&nbsp\\; What if this were your wife/OL/SO.&nbsp\\; She had tried to pass or otherwise get around a guy on a bike.&nbsp\\; Each time he cut her off then purposely blocked her in by stopping his bike in front of her.&nbsp\\; He then began approaching your wifes car, which also has your son in it, in a menacing manner.

I would want my wife to shoot his a$$.&nbsp\\; Why take a chance?

Hell, some of you guys seem to want to shoot a sumbitch just&nbsp\\;for sitting on your bike......
&nbsp\\;
I'm not defending her actions nor condoning his......jus sayin'

Agreed.&nbsp\\;\\\\\\; I'm all for CCW permits, but shooting someone is the last option after all other attempts to escape the situation have failed.&nbsp\\;\\\\\\; I think she could have gone to greater lengths to remove herself from the conflict...
