From a man to a woman never just show someone your gun. if you pull it out, use it. I know in self defense courses they teach women to hit attackers with the car door, she tried this. she tried to pass him and he cut her off, she tried to retreat. I guess in the end it all depends on your outlook on killing someone. No matter what anyone says here, he was wrong for getting off his bike, and he got shot for his mistake.

It's a shame, and I hope they get to the bottom of this.&nbsp\\; I hope they find some witnesses that saw more than the incident at the intersection.&nbsp\\; Like what all led up to that.&nbsp\\; May never know.

Four witnesses, and they all basically saw different things.&nbsp\\; That's going to be tough to decipher.&nbsp\\;
&nbsp\\;
She is justified in the shooting if she felt she was in danger.&nbsp\\; The guy on the bike became the aggressor the minute he got off the bike.&nbsp\\; She does NOT have to retreat, according to Indiana law.&nbsp\\;
&nbsp\\;
She probably contributed more to this incident than what we've read.&nbsp\\; But without proof, nobody is going to convict her of defending herself from someone that could easily cause grave bodily harm.

I'm not defending the woman (I have learned long ago to never trust a news story to report ALL the facts) but no matter how you THINK you may react to a certain situation the reality is that you never know until it happens.&nbsp\\; If she was truly in fear of her life then her reaction is understandible.&nbsp\\; The question is would the average person in her situation (as explained in court, not the paper) react the same way?&nbsp\\; That will deem the outcome if it does go to court.

i think it's pretty damming for the woman and kid if witnesses state that she opened the door.&nbsp\\; (How many reasonable people would remove the barrier between yourself and a perceived threat)&nbsp\\; You also don't go and "taunt and kick" the person after shooting them.&nbsp\\; I'm pretty shure the kids actions are indicative of the quality character of the mother.

Brandishing a weapon in an attempt to gain leverage in a confrontation is not only dangerous but can also be illegal. It happened locally in a road rage incident and the guy that pulled the gun to warn off the aggressor ended up going to jail over it. I’ve always been instructed that you don’t pull a weapon unless you are fully prepared to use it as intended.

traffic may have played a factor in blocking her escape?&nbsp\\; maybe?

I would agree.In fact I was always taught by my father that if I pulled a gun I better intend to kill.That being said.I was in a position where a Semi truck was screwing with me, tailgaiting,laughing, pushing, while I was riding my bike(and no I did nothing to provoke it,they clearly hated bikers).I showed him my gun and it was very effective.He backed off and I got on my way.

the way i read this he got off the bike looking for a fight and came up against the wrong person.&nbsp\\; Stay on the bike and leave it alone.&nbsp\\;

You're very lucky they didn't call the police and report you for threatening them with a gun. It might have ended differently for you if they had taken that path.
