and I agree with you Tech23 and Midnitevil......she needs a harsher penalty..one that will really sink in...not only with her but with everyone who hears about this.....you drive irresponsibly and kill someone.....you'll pay the piper.
Sorry about that DinoVelvet...Agreed...pay the piper.
That seems to be the problem...too many 18 year old kids. More of a parenting problem. It doesn't sink in that they are actually adults until they have ruined or ended someone's life. That's when the (18 year old kids) parents start in with how traumatized their poor kid is for having walked away from wreckage. Parent's should be the best judge of whether or not their boy or girl are mature enough to handle the responsibility of driving and at what age.
If it were YOUR daughter, sister, mother, or wife, you'd be hoping for more understanding of her side. I feel as unjustified as anyone else, but I do have daughers, sisters, a mother, and a wife also. I certainly wouldn't want my daughter to go to prison for an accident, even if it ended in a fatality. Would you want any of your loved ones to go to prison because they did something similar?
Would I want to?... of course not, but then again I told my kids when they were younger and taking on more responsibilities, that if you get into trouble knowing what you know, don't come crying to me. You know what is right and what is wrong... It will be on you. Sounds kind of hard, but they knew what was at stake... They knew daddy was not going to get them out of it. Drugs, tickets or even worse, they knew they would have to pay for their mistakes.

The Black Nail Brigade was created to deal with exactly this situation.
There are no accidents. When a person gets behind the wheel, they are responsible for their actions, the same as a gun owner is responsible for their actions when handling a weapon. If someone you loved was careless with a gun and killed someone, would you expect the judicial system to let them slide with a slap on the wrist?
People should be held accountable for their actions and decisions, in ALL situations.
Yes, I would feel bad if someone I loved was responsible for causing someone else to die, either deliberately or through carelessness. I would feel bad that they were careless and now faced the consequences.
I have to go with MidnitEvil on this one... Its on the money as far as I am concerned.

Seems to me you need to be looking in the mirror when you use the term Candy Asses...

As I had said in earlier threads: it just amazes me how quickly folks can ruin the lives of others from the comfort of their home on the internet!
"Lock her up!" "Throw away the key" "She ain't my daughter!".
Judges are paid to make decisions. They are trained for that.
I am so grateful they don't let internet commandos make these decisions! He he!
A few of you guys are so full of chit it is unbelievable.
Your attitude is probably the reason a lot of kids don't have a clue what responsibility is. You would probably give them another cell phone and a new car and say... It's OK baby... that motorcyclist shouldn't have been in your way...
I'm not sure by your post who's side you are on....I agree with you, we do give licenses to people who are not responsible enough to handle it....some kill innocent people. I am also not sure what you mean by 18 year old kid, at that age they are legally adults, and can be charged as such in a crime. I bet insurance companies agree with you about raising the driving age.
Tech23
That's right. And if they sell crack or steal a car, they should go to jail.
But traffic accidents ain't in that category unless they are drinking.
And I NEVER said they shouldn't be punished.
Early in the thread were comments about sending her away.
I am against that.
Letting her off scott free? He11 no!
I like the new phone app coming out soon that disables the texting function while the car is moving. My kids will have it as soon as my provider gets it.

Comment is totally uncalled for. Way over the edge.
Hard to trade logic when spew like that hits the thread.
We have known for some time now that driving while talking on a cell phone is as risky as driving while intoxicated. The question is what must be done to get it to stop. Lesser means, such as public service messages and billboards, are not doing the job. If it takes mandatory jail time, regardless of the age of the offender, to get the message across, then so be it.
I couldn't agree more. Driving is a privledge not a right. Sorry for your loss.
Does ANYONE here know ALL THE FACTS about this case? What were the driving conditions, was it day or night, what were the traffic conditions, did the bike have tail lights, etc, etc. Too many comments here are made without knowing any of the FACTS which causes problems with the court system. People can make all the assumptions they like but without knowing FACTUALLY what happened these assumptions mean NOTHING. If you have the misfortune to end up in court some day just hope you don't have people like this on your jury. People who agree with the decisions of the court think the system is just great. If they don't agree with the decision they think it sucks.

Best Man at my wedding and his son were killed by a drunk driver in Indiana on I-65. The drunk crossed the median and took out my buddy and his son. Got tossed in court because the judge said the drunk test wasn't valid. Boiled down to a simple 'accident'.
