It's my understanding that the burden of proof is on the State. Innocent untill proven guilty. If they can't prove you were behind the wheel, case dismissed. You are not required to testify - 5th admendment.
I have no actual evidence that this will work. Only a story from a lawyer friend who claims she beat a ticket in a Washington, D.C. court using the burden of proof argument.
Let us know what happens.

i read somewhere sometime back that they are easy to fight and get off of because the cameras are not operated by the police. it is a 3rd party company that control the cameras and go through all the pics and they take a large percentage of the fine which was found to be illegal because when you get a traffic fine, the money is supposed to be split up and go to EMS, schools, fire dept, ect. NOT a 3rd party company.
we have red light cameras and speed cameras. The local news has been running stories about people that have over 100 tickets that are unpaid.
It is really funny because one of the people is the sports guy on the channel running the stories.
Hejust laughed and still hasn't paid them. They also had a local judge that was ticketed 4 days in a row at the same speed camera. And she still hasn't paid the tickets either.
They just installed yellow lite camera 's on my major roads and it flashed got me . I was wondering who determines if you did go through a yellow lite or not. I know that the lite was still yellow when I was underneath the the lite. Any body beat one or did they just pay the fine
It's against the law yo go through a yellow light in New Jersey? While that doesn't surprise me, what's the point of having the light turn yellow? Here, it would be a violation to cross the painted stop line, after the light turns red.
There was a car behind me and I was concerned if the driver was going to stop or thinking that I was going to stop what I am trying to say is I did not want to get hit from behind. I really don't know how long before I get a summons if any if somebody looks at the picture and sees that the lite was yellow under me but the red lite turns after 3 seconds
the camera takes a pict of the plate, the ticket then gets sent to registered owner of plate, no points, only fine, no facial picts are taken, i am not sure if you can appeal this, but some states have picts sent to you with plate # and associated info. of infraction. welcome to 21st century,... oh yeah in an area of maryland recently i passed through, they have SPEED cameras, on highway..Now that is wrong......and no one to cop a plea with, like a LEO make a deal,,so if your 1 mph or 20 mph..different fines set it stone...
1984 is here.......welcome big brother.....
We have red light cameras in VA. Is it against the law in NJ to go through a yellow light? Man I'm pretty liberal but that's a bit lame. If they gave tickets for that here half the state would be behind bars. Only way to keep intersections clear is last 10 cars go on yellow. Thought that was rule everywhere.

They have all these cameras and sensors all over Japan. It won't catch you if you are doing 1-5 MPH over the speed limit. They are usually set to trigger at 15MPH and up.
The radar detector companies devised a new system to beat all of them though. The installed GPS systems in their units and constantly update to where all sensors and cameras are. It has gotten to the point that it will even tell you what side the camera is on when you pass it!

Here in Las Vegas, the last 10 cars go thru once the light turns red. Many drivers here get rear ended for being one of the first few cars to actually stop at a red light.
