Helmet ticket correctable??

I got a ticket this summer in Santa Monica. Bunch of cops sitting in front and near bartels h.d. in a motorcycle sweep I was told. Cop gave me a choice between a helmet ticket and a loud music ticket. Chose the helmet ticket cause he said it was cheaper.Pulled me over and the guy behind me on a glide over too, before i left i seen like 4 bikes pulled over one even in the harley dealer parking lot. Wish this thread was around back then.

This has nothing to do with helmets but I'm gonna ask since several of you seem to be up on the laws. I live next door in AZ. I recently removed the turn signals form my my bike. AZ does not require them on a motorcycle. If I go into CA do I run the risk of getting popped there?

I have been running without signals on my Badboy since 96. I have also never been stopped for anything else on a bike, but I do most of my riding down south or east of LA. From the above post it sounds like the cops up north of here might not be as friendly.

This is all B.S. My wife was given a D.O.T. helmet at the Pennsylvania DOT motorcycle safety program by her instructor. It has a little oval sticker on the back. My half shell has the little oval sticker on the back. In fact I have never seen an ingraved one. How about a pic., fat tony, of an ingraved one. Not saying they don't exist, just saying I'd like to see one.

I think he is from Canada, maybe it's a Canadian thing. I have never seen an etched helmet either, and I have a bunch of DOT ones.

There is a new DOT labeling standard that goes into effect May 13th, 2013. However since helmet manufacturers have been aware of this coming standard since May 18th, 2011 just about every manufacturer has been producing helmets that comply with it for the last year so as not to end up with stock in stores that can't be legally sold after May 13th, except as a novelty helmets. If I was buying a new helmet now, and it only had a sticker on it, I would be very suspicious that it was a DOT labeled novelty helmet being sold as a certified DOT helmet. From what I have read the new DOT standard is to combat the fraudulent labeling of novelty helmets as DOT approved. Personally I've never seen a helmet with a DOT sticker on it. Local cops will confiscate a helmet and give the rider a ticket if there is no DOT on the shell or if it is an adhesive sticker. I've been checked twice.

The approval label must contain all of the following...
A) the helmet manufacturers name or brand name and/or model designation
B) the words "DOT FMVSS No. 218 Certified" (referring to the DOT standard at which the helmet is certified)
C) label must be printed on the helmet shell at the back under a layer of clear coat or etched into the shell, stickers that can be peeled off or affixed to the helmet after manufacturing are not allowed

California Law makes helmet violations "fix-it" tickets (correctable).California Vehicle Code
Division 17Notice to Correct Violation for Specified Infractions40303.5. Whenever any person is arrested for any of the following offenses, the arresting officer shall permit the arrested person to execute a notice containing a promise to correct the violation in
accordance with the provisions of Section 40610 unless the arresting officer finds that any of the
disqualifying conditions specified in subdivision (b) of Section 40610 exist:

(a) Any registration infraction set forth in Division 3 (commencing with Section 4000).
(b) Any driver's license infraction set forth in Division 6 (commencing with Section 12500), and
subdivision (a) of Section 12951, relating to possession of driver's license.
(c) Section 21201, relating to bicycle equipment.(d) Any infraction involving equipment set forth in Division 12 (commencing with Section 24000 (Where the helmet law is found.)),Division 13 (commencing with Section 29000), Division 14.8 (commencing with Section 34500),
Division 16 (commencing with Section 36000), Division 16.5 (commencing with Section 38000), and
Division 16.7 (commencing with Section 39000).

Amended Ch. 258, Stats. 1992. Effective January 1, 1993.
Notice to Correct Violation40610. (a) (1) Except as provided in paragraph (2), if, after an arrest, accident investigation, or other
law enforcement action, it appears that a violation has occurred involving a registration, license, all-
terrain vehicle safety certificate, or mechanical requirement of this code, and none of the disqualifying
conditions set forth in subdivision (b) exist
and the investigating officer decides to take enforcement
action, the officer shall prepare, in triplicate, and the violator shall sign, a written notice containing the
violator’s
promise to correct the alleged violation and to deliver proof of correction of the violation to
the issuing agency.

(2) If any person is arrested for a violation of Section 4454, and none of the disqualifying conditions
set forth in subdivision (b) exist, the arresting officer shall prepare, in triplicate, and the violator shall
sign, a written notice containing the violator's promise to correct the alleged violation and to deliver
proof of correction of the violation to the issuing agency. In lieu of issuing a notice to correct violation
pursuant to this section, the officer may issue a notice to appear, as specified in Section 40522.

(b) Pursuant to subdivision (a), a notice to correct violation shall be issued as provided in this section
or a notice to appear shall be issued as provided in Section 40522, unless the officer finds any of the
following:

(1) Evidence of fraud or persistent neglect.

(2) The violation presents an immediate safety hazard.

(3) The violator does not agree to, or cannot, promptly correct the violation.

(c) If any of the conditions set forth in subdivision (b) exist, the procedures specified in this section or
Section 40522 are inapplicable, and the officer may take other appropriate enforcement action.

(d) Except as otherwise provided in subdivision (a), the notice to correct violation shall be on a form
approved by the Judicial Council and, in addition to the owner’s or operator’s address and identifying
information, shall contain an estimate of the reasonable time required for correction and proof of
correction of the particular defect, not to exceed 30 days, or 90 days for the all-terrain vehicle safety
certificate.Amended Sec. 27, Ch. 908, Stats. 2004. Effective January 1, 2005.

correctable offense? get caught wearing a non approved lid and go down to police and show a legal lid and get off--what is to stop people from doing this several times? should be a notation on your driving record, and if you ever get ticketed again for the same offense(no helmet/non DOT helmet)...should be serious fine and definitely go on your record as a moving violation.
if you clowns in california are going to split lanes, the least you can do is wear a legal helmet. the lawmakers in your state(representing the citizens) have deemed it necessary to wear helmets. take it up with your legislature--in the mean time, obey the law and quit looking for loop holes.
