In some states if you are involved in a crash and register anything at all, it's a DUI. And others it's 0.04.

I don't usually have more than two during a ride altogether. This day it was raining, our bikes were out of the weather, and it was hot. I drank three beers and ate a sloopy joe in an hour and twenty minutes time. I was just in the wrong place at the wrong time....no since making commits about the other guy. BUT.............someday I will see him again.

Canada is much lower than a .08% BAC. I know no other states that have a lower limit EXCEPT for CDL operation and drivers under 21.
Ontario an "impared" is .08, but they can, and do take your lisence for 3 days for over .05 I've never heard of a impaired charge sticking in an accident below .08 here.
I'm not sure how it works where your from but in Arizona the over.08 is a separate charge from the driving while impaired. Any alcohol can make you impaired especially in an accident.
shame about your bike I love that front wheel on there...
if they total it you can buy it from them cheaper and rebuild it. say they say it is totaled, and offer 10,000, take the money and ask to buy the bike from them, buy it for $5000 and rebuilt it. it will be a salvage title but if you are keeping it for life and not looking at resale then it is a winwin...

I was a little upset that they were making me plead guilty to something that I had not done. And the guy that hit me gets off with no tickets at all.
No one can make you do anything you don't want to! Personally, I wouldn't cop to something I know I didn't do, plain and simple. I would also try to not put myself in a situation.. I'm just saying.
That said, in CA, as well in most other states, it doesn't matter if you weren't at fault, if you're DUI or impaired, it's your fault.. Also in CA, if you blow less than .08, they can and will nail you for impaired! I learned that one on the Jury I was on!
Glad the legal is over and sounds like a deal was in place. Sometimes better to pay and get out free when it comes to a DUI charge, yes fix the bike during the healing process. Sounds like a good finish to a bad thing
