To the OP: I'm not for frivolous lawsuits, and I really don't really care who pays for it, but if someone negligently left oil on the road please hold them accountable. Not for yourself, but for others. The next time they do that it might not end as well.

I agree. See if you can get the tow truck company to pay or at least the deductible. I am glad you are okay as well.

You should stop trying to read between the lines because you're not very good at it. How does getting hit by another vehicle relate to identifying and avoiding potential road hazards?

That must have been some spot of oil considering the OP had "like 2 quarts" on him.

As he should have been but meanwhile he was heading straight for a nasty pool of oil.

I apologize to the OP for my rants, I mean no disrespect. I appreciate the opportunity to voice my opinion on these forums with fellow riders.

Well the bike is now at HD get a once over and the insurance adjuster suppose is to come out and do their estimate some time tomorrow. As far as a law suit not my style, tried to find out who did the toe there from the cops and they had no record of a tow on the dispatch log, I tried to find out the names of the parties involved and they said they weren’t allowed to give out details because it had a pending investigation hold on it.

Best I can figure is that one of the RO's called a private tow and the tow truck driver took both cars and rolled. Only reason I say that is because I use to tow for a small company here for a couple years and my wife still works there. Things like this would happen, I'd roll to an insurance call and the cops would look at me like what the hell, I'd ask the other drive or cop if they wanted me to take the other car and sometimes they say yeah, but I always kitty'ed a scene for just this reason.

The only way I figure that I can find out the tow truck company is to get a PI because the PD won’t release info on pending cases to anyone but an LE agency or licensee PI. So I don’t give a $hit that bad, told the insurance if they wanted to go for it but I don't think they care. It would cost them too much money. Plus I know a couple of people at HD, I won’t say anymore till I get my bike back. I'll post before after pics.

To NoCoLoco you said it yourself that I stated it was sunset when this happened, you also stated that you weren't there and you where glad I was ok, thank you for that. But I digress, how alert are you when your direction of travel is going from north to west when making a left turn across a lane of traffic into a blinding California sunset. (I say California because everything is bigger or greater here that why they say we have higher taxes here) There was no way I was looking for discolored asphalt or even on my radar. If I could find him I would problaly just bitch the owner of the company or diver out but that it, maybe get my deductable back. But what if it had been a jack *** kid wanting to punch it and hit that spot and there was a young woman and her child walking on the side walk across the street. It wouldn’t matter who fault it was then and that why it tow truck company should be held accountable. The tow truck game aint pretty or cool but there's a lot of thing you do or don't do can get motorists hurt or killed.
