First, lets all be very, very glad that your brothers ok. I have recently started riding after quite a few years off and I can tell you that people are much worse now than they used to be. I have had a number of really close calls in just the last few weeks. I am speechless about the fleeing charge. At least charge her. Then it's up to the Judge or Jury to hear her excuse. Tell the lazy cop "thanks for being her defense attorney". I hope she was at least cited for something. Now contact the States Attorney and ask them to charge her further. Also, most jurisdictions have a "victims assistance" office that may be of some help. I really don't think that not charging her with fleeing will affect the outcome of a civil trial. After all, she was at fault in the accident. Once again, lets not lose site of the most important thing here and that's that at least we don't have another dead biker brother.
Glad your Brother is OK for the most part. That stoopid biotch needs to be made an example of. If the roles where reversed you and brother would be in jail claiming you where affraid of the crazy ol white lady in the car. She should be nailed to the cross and hung out to dry next to the nearest biker bar.
The cops not filing charges is BS. You or your brother should keep the pressure on to see that the your local DA either presses charges or provides a legit reason why they would ever consider letting this go.
Glad your bro is alright ... that is the most important issue here. Next, tell your brother to get an attorney and do not discuss anything with her, her attorney or her insurance company until he's advised from his attorney. Tell him to be ready for a long, drawn out ordeal. My wife was hit from behind by a dump truck who left the scene ... I ran him down the interstate while giving LEO constant updates to his location. Long story short, it took two years to bring the full case to court but he did end up loosing his CDL (so now he probably drives without a CDL [:@]). Just a tip ... the biggest ad in the yellow pages doesn't constitute a great attorney. I have zero faith in our legal system ... bottom line is who ever has the most money usually wins.
Thanks Jeff. I feel the same way. I worked with many LEO's up north and I was thoughly discussing that with the officer at the scene. I asked well how frickin far must she travel before YOU consider it fleeing the scene of course I got no answer!! I am still upset about the whole thing but it aint worth losin my cool. Should know more tomorrow and I am gonna push the fact that I think he should talk to a superior of the department if you got that statue I would appreciate it. PM me for email address or fax number however you wanna do it

Call out the PD and Raise Hell. SHe hit someone and left the scene, thats no excuse for her or them. Pull the phone out of her Azz and she could have called 911 and stopped, but she left the scene. Start with Sergeant then work your way up. SHE should be chaged with Leaving the scene of an accident that had damage and injuries. Let me know if you needed the statue looked up I will grap my TX motor vehilce laws book from locker at the station.
Jeff
Call your local Prosecutor's officeand advise them about what happened. They will more than likely call your local PD. Try that I hope it works for you.
The woman was criminally negligent and a complete moron, and the cops that didn't charge her were not far behind... I was badly hur a long time ago (1999) from someone turning in front of me at an intersection. Compound fracture of both bones bleow the knee on my right leg. 7 surgeries and still almost lost had it amputated. It's still there, just a wee bit shorter than the other.
Whenever I see some cager looking to turn anywhere near me now, I slow down and expect them to try to kill me. And I am not shy about laying on the horn as I approach as a pre-emptive strike even if they are looking and smiling right at me.
The noise probably pisses some people off, and the cager's are all probably wondering why I am laying on the horn as I go by, but I will be damned if I will ever let some knucklehead try to take me out in a car again. I am looking for a nice chrome trumpet air horn for my bike right now.
Get an experienced lawyer. Her insurance company should be paying all costs associated with your brothers medical care, and the repairs to the motorcycle. For such a blatant at-fault accident and leaving the scene, he should also get a little extra for his trouble. Maybe enough for a nice '08!!!
