Custom molded are the only way to go. I've tried others and they occasionally end up coming out/ loose. You can pick up the kits to make your own at any sporting goods store or Amazon for $12. It's enough to make a couple low profile pairs.
Westone custom molded. Had my hearing checked and I lost 5 dB in 4 years,and I always used plugs with 20db nominal noise reduction,I guess it wasnt enough. I went up to 35. You can be a tough guy or claim ya want to hear your environment,but your hearing is taking a hit every day. That day when you cant hear well is coming...
I've been using NoNoise earplug with my full face helmet for a couple years.
They cut out the wind noise while still letting some of the higher pitch noise through.
I'm going to guess that the law actually applies to head phones and ear buds rather than ear plugs. I think any reasonable LEO will understand the difference.

Title 23 (XXIII), Chapter 316, Section 208,."Equipment for motorcycle and moped riders" makes no mention of the prohibition of ear plugs. It could be in another section, but I didn't see anything else pertaining to obstructed hearing.
