After spending 3 monthsin the hospital&nbsp\\;and a year and half in rehab after a wreck I can say all the guys above are right. Your insurance will go after hers if she is found at fault depending on your state. I would most certainly see a lawyer as you may have things wrong with you in a few weeks that you didn't know were wrong now. Heck they found out I broke a vertabrae in my neck 2 months after the wreck. They should not charge you for a consult and and an evaluation. I will say though that is oculd cost you a bit in fees for investigation if it drags on a bi and he will get 30% at least for his work if you win or settle. I'm still riding strong and rode to my rehab appointments on my fixed bike after. Get back on, just break yourself in slowly on safer roads. I wish you luck and glad to see you are still with us in one piece!

Wow, first, glad you are somewhat OK and can post the story here, beats the alternative.
Yeah, First a call to the Insurance co, then bike to dealer. You never said if she stopped, was there a Police Report etc. If so, you need to get coppies of all the paperwork, pictures of bike, pictures of accident scene, pictures of her vehicle, any witnesses? You need statements from them. Protect you backside as best you can.
I hope all works out, bike gets fixed or replaced. Only you can decide if you want to continue riding, I certainly hope so, but that's you call.
Glad you were wearing the protective gear. I too wear a full flip helmet, yeah I'm not a cool as the guy riding with nothing but in case of a "getoff" as yours, I want all the protection I can have, helmet, mesh or leather, gloves...never know.

Be safe all, the crazies are out there. Also, seeing a lot of road debris lately, watch for the road gators and junk&nbsp\\;on the road.

Glad to hear you walked away.

I never forgot getting hit and it's always in the back of my mind. Even after 5 years I slow down quite bit for upcoming intersections. I start scanning from the moment I can see what's coming and keep looking all the way through the intersection. My slowing down (i'm not stopped BTW) bugs the crap out of my buds but they understand.

In the end, there should be NO money out of your pocket.&nbsp\\;&nbsp\\; Between your insurance, HER insurance, and a civil suit (if it comes to that), you should be reimbursed for all damages, tow fees, helmet/jacket replacement, all medical bill deductibles, and reimbursement for time away from work and travel costs to and from medical treatment.

It is HER fault, and SHE and her insurance company should PAY.

Yes, contact a lawyer, but you can probably handle this yourself. Without serious injuries, you can expect less than $1000 in P/S.&nbsp\\;\\\\\\;\\\\\\\\\\\\\\; Physical therapy visits will make you whole faster and increase your settlement amount somewhat.&nbsp\\;\\\\\\;\\\\\\\\\\\\\\; Your injuries and your bike repairs are two totally different parts of your claim. For the bike, have a dealer estimate the damages, pay him for his time and then take the bike home.&nbsp\\;\\\\\\; Carefully review the estimate and request a 1-party check from your insurer since the dealer takes too long to repair your bike, etc., etc.&nbsp\\;\\\\\\; Get your parts lists together from the estimate for Zanotti's or Chicago HD and order the parts.&nbsp\\;\\\\\\; Do whatever of the work you can yourself, there are parts to replace that anyone that can turn a wrench can install.&nbsp\\;\\\\\\; Have the work you can't or won't perform done by a competent independent mechanic. You'll save money and experience better customer service.&nbsp\\; Best of all, you won't be stuck with costs and parts the dealer wanted for your bike (returning it to as it was and&nbsp\\;scratch-free).&nbsp\\; I went this route and instead of the dealer's plan, got my bike back with a Supertrapp 2-into-1 exhaust, chrome front end kit and a 101 hp gear-driven cam motor.&nbsp\\; Sure, there are a couple of tiny scratches that were already there in the bike already, but so what.&nbsp\\; If I can do this, you can do it and have a much better bike back afterward.&nbsp\\;

You need to make sure the dealership x-rays the frame for any cracks or damage, especially with that kind of crash. Don't just bolt on all the new parts without knowing the frame is sound.

My advice? Promise the wife you'll double your life insurance, and maybe she'll be easier to convince.&nbsp\\; Just don't give up riding.&nbsp\\; As far as the rest of it goes, I'm sure it will all work out.&nbsp\\; It always does.&nbsp\\; Oh, BTW...you'll probably be a LOT more sore today than you were yesterday.&nbsp\\; Hope you feel better soon.

One thing I find peculiar....how many people do you know stop riding in cars after being in an automobile accident?&nbsp\\; (I'm sure they are out there...I've never met one...but it is such a common comment when one has had a bike accident).
