Sorry to see the rust on a new bike. In the Aviation feild the part would have the corrosion removed ( you can't clean rust). Then the part would be checked to see how much of the part was removed. If too much was removed the part would be replaced. Your frame is rusted at a load bearing point. That's not good. Keep a cool head talk to (not at ) the dealer, than contact HD customer service.
i domt see them buying it back or giving you a new bike...but i would argue for a new frame. but as already stated.....dont go in yelling and screaming.
Holy Crap. That's disgusting!! I'd lobby for a new bike, what with the age, and the other problems you've had. Maybe you can make a good deal on an 09. Maybe this is a blessing in disguise.
That does bite man. Ditto to what everyone is saying, blowing up at the dealer or service folks won't get you much favor. Go in with a cool head and an open mind. I would want a buy back with the other concerns you have had.
If you are a good service customer of theirs point that out too. I don't care what anyone says, the first question a factory rep is going to ask is what kind of service history you have with them. Go in with an idea of what you want and why and continue to politely go up the ladder until you feel like you've gotten a fair shake. If the dealership screws you around then call Harley directly, at a minimum I would settle for a new frame but would go for a buy back. You may want to look up your states Lemon laws to see if they apply to motorcycles or how they read to support your case and if they apply then use the lingo that hints to it when you talk to the service manager or general manager of the dealership, this will put them on alert that you an informed consumer with a problem and know how to do the research to get things done. Just my .02 as someone who works in an auto service dept.

Yikes. That isn't a great looking picture. Four month old bike? I'd be all over the dealers *** about it. Same with you...a buyback makes sense. That is a serious defect.
I was cleaning my 08 streetglide yesterday and found a 3 inch piece of powdercoat lifting off the frame. Its the entire upper section of the frame upright behind the left side bag and cover. The frame is rusted under the paint. This bike is only 4 months old. I just cannot win. I cannot wait to see the dealer on this one. WTF
Do you ride it? Is it a road bike? Hell don't worry about it, if it was your car would you even give it a moments thought?
Ride it and enjoy the ride. It's just a freakin mode of transportation!

Sux man. Hope you get it resolved. But I'd be really surprised if they did a buy back. The best you are gonna get is a new frame and maybe some consolation prizes (freebies).
