Thanks for everyones input. I will remain calm at the dealer and the factory level. I will be checking with the state laws for bikes too.
I agree that it was something in the process of powdercoating because the inside of the same side rail is rusted too. Its not just on the surface its deep into the metal.
This bike has always been garaged when not in use. Yes It has been in the rain but that should not cause this.
Do you ride it? Is it a road bike? Hell don't worry about it, if it was your car would you even give it a moments thought?

I do ride it. It has 8400 miles on it. I did pay hard earned money for a bike with paint defects.
If it was my truck and paint was peeling off it at 4 months old. There is a issue.

You would have to be insane to "Just drive it and don't worry". That's just a rediculous statement. As someone mentioned earlier, a buy back liely has to do with a safety issue. I beleive this IS a safety issue. I sure don't want to have a frame under me wasting away. Your ride is 4 months old and you deserve a new frame at least. Keep a cool head, contact HD directly and see what comes of that. If they do not satisfy you than contact a lawyer. Document EVERYTHING. At least that is my advice. This sucks. That kind of coating failure and subsequent rust-out can turn into a structural problem real quick.... who knows where else on the frame it's doing the same thing??
I would push for at minimum a new frame, that kind of QC is just BS...

Went to to dealer todayt and they said(Never seen that happen before). They took some pictures and are sending them to Hd. The dealer wants to replace the frame. I am waiting to hear from them now.
