I have some friends from Scotland and he told me that in his country it is a very large fine if you are caught driving while talking on a cell phone. We might need something like that here.

He's almost right, It was Ł30 fine [NOT ENOUGH], but people carried on using mob while driving, so it went up to Ł60 [STILL NOT ENOUGH] but people still kept using mob, so it changed again and now it's Ł60 plus 3points on licence [unless it's proved you caused an accident, then the fine and points could increase] BUT people are still using their mob while driving....if you get such a law over there in US I wish you more luck with it than we have had...How do you get through to people that it is dangerous to use the mob whilst driving as so many find out the hard way...
In regrds to many posts, I have no intentions of sueing them unless they want to play F--k, F--K!! and that is not want I want. I just want my scoot fixed and that is it. I am not a sueing type. I hope it does not go that way.
I was just hit this past Friday night by a 17 yr old C--T talking on a cell phone that tried to leave after hitting me in the middle of town!!!!!!!! She came shooting out of a alley talking on a cell phone and looked right at me and continued on out at about 8 feet. I took the hit by her front drivers tire and door area dropping me instanly.
She then started screaming and took off dragging my bike 90 degrees around ripping the windshield off and grinding the bike on the road. I only hit her at about 15-20mph, but it was enough. I slammed into her car with my right shoulder and hip and landed with my arm and head under/near her car. I felt her starting to leave and jumped off the road to the side. Thankfully some people watching saw her leaving stopped her at the intersection where she was trying to leave and took her keys.
The cops arrived and did not ticket her but wrote the AR stating she was totally at faulty for pulling into the flow of traffic, not yielding to the flow of traffic, and attempting to leave the scene. The RO stated that her Ins. will w/o question pay for all for she was at fault. We will see this week.
So be careful out there for they do not look for us or care!!!!!!! Bike has mostly cosmetic damage, fairing, windshield, engine guard, highway peg, saddle bag guard. Myself, new pair of BVD's and a few Bud Lights and I will be OK. Bag of ice for the beer and I will share it on my shoulder and hip.
Scary stuff, glad you are OK. There ought to be a law establishing a minimum age for driving and using a cell phone.
A woman hit me by changing lanes into me and knocking me into the barrier on a 50 mph section of road. My bike was totaled and I went away in the ambulance. She did not receive a ticket. I actually talked to the cop afterwards and he said there was no point in giving her a ticket since she was all shook up, near hysterical, and her car was damaged as well. WHAT THE ****?!?!? Cops. Jezus.
Hate to take away freedom of choice, BUT...talking on hands on cell phones and texting while driving are very serious problems facing us as drivers and bikers. There are too many incompetent drivers around to begin with. Now distract them even more with cell phones and text messaging and you have the potential for disaster. Train wreck anyone?
Talk on a cell phone using a blue tooth if you like. But have both hands available and for god sake pay attention. Unfortunately, that is a lot to ask in our country today. Where will it end?

Talk to an attorney. Then decide if you want one or not.
As a citizen you have the right to sign a complaint against this driver. The evidence to support your charges is the accident report that was made by the police. It would be helpful if you have witness's also. It is not uncommon for citizens to sign a complaint against another driver. The officer didn't do you any favors by not issuing a citation. It may have been just a beat officer instead of a traffic investigator and he/she may not of wanted to bother with going to traffic court. Typically a traffic officer will determine fault and site the offender, that's in their job description.

Second Chance, I don't know where you were, but in some states police cannot cite for traffic violations or misdemeanors they did not witness. That is a constant frustration for us here in the commonwealth.
