i was heading to st.augustine yesterday and im going through daytona beach heading north im just passed main street and this little cu-t comes flying up to and past the stop sign and stops 4 feet into my lane from where i was riding i had to move over to the left or i would have nailed her. and there was a cell phone to her left ear can you belive that
Me too! And I wouldn't want to think that she is probably bragging to her friends about not getting cited and about this biker who hit her while she was strictly obeying the law. So sad that she was not cited and as mentioned before, I would at least talk to a good lawyer. There are lots of biker lawyers around who would completely understand. Of course the final decision is yours and you should do what you are happy with.
Glade to hear you are ok, Ride can be repaired. However I am amazed that she was not arrested on the spot for leaving the scene of an accident, I thought that was a felony in most states. It was clear that if people had to stop her and take her keys that she was going to flee the scene and had no attention of saying. Can't believe the Officer would let that slide.
I was sitting at a red light and some dick on a cellphone pulls out of 7-11 and plows right into me, he never even looked up,I asked a guy who saw it to please wait for the cops and give a a statement, he got a ticket! Glad to hear your ok.
Hey SC, glad you're OK and have to admit you are one understanding guy. If I'd been hit like that and the driver tried to run (even if it was a kid) I would be tempted to want more than my bike fixed. Punitive acton may or may not change this driver but it's worth a try.

By the way most cops will give the cager the break, not the biker.

We have a biker lawyer advertising on TV in our area and the reason he started, because he was hit himself on his bike and cops did nada, just like with OJ.....so civil court is a good option.
You can file the complaint and they will have to issue her a ticket, you will have to go to court as a witness, and if you find a witness to back you up it will help make the ticket stick. She may file something bogus back at you so you drop your charges. Stick to your guns and go after her, she needs to be taught a lesson before she kills someone. If she has a ticket her ins. will have to pay out. I know here in NJ it is illegal to talk on a cell phone while driving it is a $180 ticket.
