You might try Redline V-Twin transmission oil instead of motor oil in the tranny. I had a similar problem and that fixed it. Besides that, regardless of what the MOCO says, motor oil will never serve as well in the tranny as gear oil.
Might want to warn you about using Redline Shockproof Gear oil in the transmission, There are side affects from using it. Namely Not a loud clunk when going into gear, easier to find neutral, no loud gear noise when riding, If you can live with that , then go ahead, a lot of us have done the same thing.
The shift shaft seal is a single lip seal with no skirt spring and are VERY prone to leaking when running thin synthetic motor oil in a trans that should have gear oil in it. My son is a teck and has changed hundreds of shift shaft seals on bikes running Syn3 in the trans.
He said the other day he saw a new seal that is double lipped with a skirt spring, so things are looking up.
Sounds like just one more case of the MOCO saving about two cents per bike on cheap parts and then spending huge amounts on warranty repairs or just refusing to fix it and causing poor customer relations and losing future sales. They never, ever learn.

I had shifter seal replaced at 16000 miles. About $380.00.
I switch my 02 RKC to synthetic in all three holes at 17000 miles and oil started seeping through the gaskets on the crankcase, but not the transmission or the replaced shifter seal.
At 25000 miles and a year later, the synthetic oil doesnt appear to be seeping through my crankcase gaskets anymore.
I may be wrong, but I think CVOs have a different transmission.
My guess is your shifter seal is wearing and the slipperier snythetic oil found the leak faster than the old oil.
I paid a lot for this bike a love it to death but should I take it back in a tell them I want the seal replaced or should I stop worrying about it so much. Has anyone else had this problem?
If it is not dripping I would not repair the seal just yet, but would keep an eye on it. IMO you should drain the Syn3 from the tranny and install a synthetic gear oil like Mobil 1, Royal Purple, Amsoil, or Redline. Use 85w140 or higher and the leak may disappear.
Dog155 made a good point. Check to make sure the leak isn't actually overflow from the breather tube. It is the curved rubber tube located slightly above and rearward of the area you are referring to. If the dealer overfilled the tranny it can barf, but this is unlikely since it holds 1 qt. and that's hard to screw up.
