I do believe that it is only on the 08's and up. The 08's have to be turned on by the dealer. They did one free turn on. You would have to pay to have it turned off. My 08 has it turned on and it does come on once or twice in the summer. The 09's and up you can control it by rolling the trottle forward like the OP said.
I can turn my 08 on and off as much as I please. No dealer flash here. From what I understand it is built into the ECM on the 08 and above bikes.
