Default Custois work issues

So I give my Harley to a reputable guy (won't mention his name) over a month ago to do about 8k of work. Not sure why I dropped it off so early but wanted to get it up there hoping the work would start as soon as possible. I knew he would be away in Daytona for a while. The bike is at his shop about 4 hours from me. I was to get sketches and paint samples last week and never received them. I have been calling the guy with no answers or return calls. He has my bike and 5k deposit. What do you think?
Am I screwed? Next steps?

I hope you have some kind paperwork about this. I would be on my way to where ever his shop is to PU my bike & money. I would not accept any excuse from him!!!! Good Luck.

Couldn't drive up there when I knew he wasn't at his shop. I had some local friends checking for me. The *** sent me an e-mail stating he filed bankruptcy. I am heading up in the morning to get my bike but I may loose my 5k deposit which really pisses me off. If I do, this as---le's name will be posted on every bike site I can get my hands on.

Picked the bike up today. Went to the court house while there to file charges against him.

oh man...That really sucks...You will probably will not see that 5k...especially if he owes more to other creditors...You'll be the last in line.
