I agree with what sublime_ac said in his last post: the rack that failed is not the MB rack I have now; and it's probably not the same as the previous rack I purchased from MB with the angled sides that I had and that 131tman shows in his post above.
Thanks to sublime_ac for the pics and providing more useful information for those of us who purchased racks from either MB or BRC.

While the racks are different I must point out one similarity; they are all levers with considerable weight placed at one end, secured by somewhat smallish tabs at the opposite end. The Harley detachable bracket is not as much of a lever as these, it squares / centers the weight over the two mounting points. While not as attractive, it is a better engineered design.

I am sure if you do Nick will stand behind the products he has sold. BRC is no longer in business, so your resolution may not come out as good as mine, but who knows, Brian may decide to take care of you as well
As for me, I will be much more cautious with third party products that can impact the safety of my motorcycle.
The current two-up detachable tour pak rack, p/n 53276-04, was introduced in the 2004 model year. Previously, HD used a two-up detachable tour pak rack that used the forward docking points that a detachable sissy bar used. Check-out the picture in this ebay listing to see a picture of the older version:
This older version was used from at least the 2000 model year, and perhaps earlier. I'll see if I can track down an older P&A catalog at my local dealer and get a p/n for the older version rack.
Also, HD sells a luggage rack that attaches to the sissy bar, so the luggage rack supports the pressure of the passenger plus whatever goes on the luggage rack using the same docking points the MB rack uses.
I mention these facts not to say that the MB rack won't fail, but to point out there isn't anything inherently flawed in using the forward docking points for a two-up detachable tour pak rack. I'll continue to pay attention to the docking hardware on the bike to assure they are well secured and free of apparent damage, and do the same for the rack's mounting points. If I have any problems, I'll be sure to post the facts.

what year is your bike? My guess is its later then a 2009........
If this is the case, it would be the reason why the front point was a modified shock bolt.

I have a 2006 so Im not 100% sure on how the 2009 and up mounts work.
i have an 08 ....i was told when i got my rack that the newer version used the shock bolt for the front mounting point. it was stronger .... iam thinking maybe gussets can be welded on to beef that tab up.
Different design, as stated previously mine used modified shock bolt as forward mounting point. Metal at forward mount is much thinner on my bracket. It was installed correctly, looked pretty secure, metal completely failed to hold chopped tourpak with a notebook computer and baseball cap.
I have one of these mounts as well. I remember shortly after I bought mine they started offering them to fit stock bikes (I had to bend mine in like many did as it was designed to fit over their fender cover). Top of my front mount is like the OP's, but the bottom is probably 2.5-3 times the thickness exactly like 131tman's. If they offer one like Pingman's updated version again I will probably upgrade. For now I think this one will hold as we have hit some ridiculous bumps with it on and it did not move. My front docking hardware is also billet aluminum.
FWIW- I bought a black rack from Brian for 2010 RG. Just came back from 6000 mile 8 state road trip with my wife on the back and a fully loaded Tour-pak. Rack looks perfect. I'm not sure if new frame design is better. Looking at those pictures.........That must have been one heavy laptop!

Current model Macbook pro in a protective sleeve.. Total weight less than 10 pounds in that pack.
Is your rack the same design as mine??? So far mine is the only one with the thin fingers that hold on to the modified shock bolt... THe others look much sturdier than mine.
