I called RR and asked the same question. They said both sizes would work on my 2009. I also talked with my dealer and they said that they have had some of the 3.5" pipes on 2009-2012 bikes turn blue due to the cats in the headers. I went with the 4" because the OEM was about the same size and they look very good.

3.5" will be louder and not as deep
4" will be deeper and not as loud

I have the Rinehart 3.5" mufflers and when I bought them I made two purchases in one. My first and my last. Rinehart makes some of the cheapest pieces of chit on the market. I have had them for less than two years and all of the chrome is falling off of the end caps and one of the mufflers sounded like a can full of rocks until I pulled the baffle out and wrapped the end of it with glass tape and drove it back in. When I contacted my dealer about the chitty chrome, I was told to just bead blast them and paint them black because Rinehart would not replace them.
Yes, these are made by Clearline for Rinehart. I am sure you will hear a lot of folks on the forum tell you how great they are but if you really want to know how great they are, go to yahoo or google and type in Rinehart Rattle and see how many hits you get.

I considered going from 3 1/2 to 4 but cant justify 1/2 inch for $600 for less low end
I have 4" on my RK and 3.5" on my Ultra, both 103. 4" are definitely louder in the current Rinehart exhausts available. I've also had the old 3.5" Rineharts on several other bikes and they have definitely made them quieter.
