I think you have had a lot of poor advice on your bike.

The modifications and the results of those modification and possible other issues.

and it sounds like it's gonna be expensive for you to start over on another bike ( and if you do get better advice this time around).

I dunno, your money- but it sounds like it's being pee'd away.

black smoke ONLY indicates rich mixture.

so thats probably a set up issue with your tuner rather than a mechanical issue ( white is oil ), but checking fuel pressure is probably a good idea

as pointed out above, the eitms turns off the fuel-- so would not result in black smoke, either the tech has no idea how the bike works, or he is not able to clearly explain things to customers ( which happens)

Why would you trade it in because your frustrated with a minor problem when its still under factory warranty? Seems pointless to me. I would take it to another HD dealer. Like right now! The svc mgr may be a good guy, but his techs sound like they don't know what they're doing. And being a good guy isn't gonna get your bike fixed right!

Same service dept is going to finish final assembly and setup of your new bike as well? Sounds like a mistake in dealers, the bike u r trading was set up by the same group of people as the new one? FIND ANOTHER DEALER!

Blue smoke = oil.....Black smoke = fuel. I'd take it to another dealer first.

Not sure where you are, or where the OP is, but Colorado's "Lemon Law" doesn't apply to motorcycles. It's kinda stupid really...

Ever consider the 120r versus trading in for a diff bike? I saw a dyno sheet for the 120r with tman cams that would make your face melt.
This would be the most fun of all the solutions on this thread.

sounds like it needs to be taken to a good tuner and setup on a dyno. I agree a new dealership with better service technicians is needed as well. Unless you just don't like the bike I wouldn't spend the money to trade. The 120R would be a good option if money is burning a hole in your pocket.

Go to a different dealer and have them repair it under warranty. You will take a huge hit on a trade, they will repair it and make a kill on selling it.
