Well, that sucks. But I really don't see how the dealer is liable here. He offered a warranty, but you declined. It doesn't seem fair that he should be on the hook for repairs if you purchased a warranty, or even if you didn't. Obviously the bike ran fine for the test ride and for the first few days you had it. Was the terms of the contract "as is", or was there a limited warranty?
All bikes will eventually break down over time. Even those that are meticulously maintained. Neither the dealer or you knew when it would happen.
But I can see how this would put a really bad taste in your mouth, and the dealer might want to try to avoid a negative experience. If I were the dealer, the only way I would offer to fix it was if you agreed to purchase the extended warranty. At least he recoups a bit of the cost of the repair, and you have piece of mind. Maybe you can approach him that way as a compromise?
2005 is actually a very good year....hang in there until you shake the bugs out...the bike was probably sitting for a while and has a few minor issues (bad gas, weak battery, etc).
Sorry for your trouble, but if you bought it from a dealer there should be "some" warranty. 90-day maybe? May be worth checking into if things get serious.
