sounds like you've got a flat spot on the armature thats preventing contact. The leaving it in gear and pushing it a bit is probably enough to get off the flat spot. I would however be concerned that the gear is not fully disengaging.

One quick and dirty check is to use a screwdriver between the solenoid battery terminal and the small solenoid coil terminal. This eliminates the wiring to/from the starter switch, and the starter relay contacts and wiring. if it turns over readily, suspect the switch , relay, wiring. If it still acts up, next check is the solenoid. If Big Twin especially, the solenoids have a limited life before the contacts (the movable one usually goes to crap first) get so pitted they fail to conduct enough amps to turn the starter over.
You say the starter is new - who replaced it? Have seen occasions where the new starter, especially the cheaper Hitachi substitutes (not actually Hitachi), did not quite fit the gear housing correctly. The resulting misalignment caused some hard starting whenever things were in a certain position.

The starter was replaced by me 3 months ago.
The unit is a Nippondenso 1.4kv
As stated the solenoid works, but sometimes nothing occurs when you press the start switch. When that occurs you can push teh bike in gear just a little bit and then the starter will start
