Damm good thing not everyone thinks like you otherwise you would not be afforded the protection that the Military provides. I guess we could do away with **** Tests and let the Potheads protect you!
Sorry to hijack but had to say something. If you feel the need to take that stand, I am here to protect your freedom to do so!
Alot of "PotHeads" know how to use a fire arm! Want to talk about those **** tests? how is it I can use Cocaine or Meth and pass one of them tests in 24 hours? Those **** tests are worthless at finding and removing the real drug problems! A guy that smokes a joint at the end of the day is not a threat to anyone....I'd be much more worried about the guy strung out on coke or meth headed down the highway in a 18 wheeler!!!!
Thompson v. Smith 154 SE 579.
"The right of the Citizen to travel upon the public highways and to
transport his property thereon, either by a carriage or automobile, is
not a mere privilege which a City may prohibit or permit at will, but a
common right which he has under the right to Life, Liberty and the
Pursuit of happiness."

I can't speak to the issue about worring about passing a drug test but I will give you the part about the threat of someone rolling down the highway in that condition! That has the potiental of immediant bad results.
Maybe I used the term pothead while being a hothead. I have been the troop at age 18 in the barracks to the now 45 yo in the reserves. Does it happen in the Military??? Hell yes it does! Do they get caught all the time? Hell yes they do! Like I said, I'm not versed on getting high and passing a test. But if you are going to be in the Military, you do have to subject yourself to random testing. Ok I'm done! ;-)

What jurisdiction is that, and what court issued that opinion? Cities prohibit and/or permit this kind of thing all day long. Look at special "truck routes", etc.
And just the fact that you MUST have a valid driver's license in order to travel upon those public highways makes that an assinine statement from whichever court issued it.

there is a ton of court cases that has dealt with the same issue, not hard to find. you can find out what court issued that opinion by the case number.

Here's some more info. Interesting website, claims being forced to get a drivers license is unconstitutional as well.
Man, everyone can beotch and moan all they want. it won't change a thing. It is settled law in the eyes of the supreme court and has been for years. Other than a few minutes time, it costs you nothing unless you have been drinking.
I live near the coast in Florida and they set up sobriety check points all the time about 3 miles from my house. Almost always in the same spot at the same time. I can't help but go through them. It isn't an inconvenience unless I've been drinking, then I take a different route home.

That case number isn't going to tell me which court, out of the millions of courts in this country, that came out of.
