Having experienced the hospitality of the people of Green River, Wyoming I'll weigh in here. (Nice town by the way)
I think your chances of getting a new bike are pretty slim unless you lawyer up and are willing to pay him/her a lot of money to get the bike completely replaced. I'd go for a replacement engine with your VIN on it. I don't think I'd trust the same HD dealer to do a complete, split cases, engine re-build. I mean, they did leave a rag in there that I presume wound up in the crank case (from your description). That really wouldn't give me a lot of confidence in their abilities. I would also want a loaner bike in the meantime. It happened and there's nothing you can do about now except for managing to get yourself what you think to be your best option. I hope it works out well for you.
I forget the name of this motel but the guy there was nice enough to let me stay longer and work on my bike in the parking lot, heck he even offered to help. It was right next to a bowling alley.

I had stage 4 upgrade kit installed by dealer in Wyoming they called me and told my bike was ready and to pick her up, i left the shop and didnt make it a quarter mile away and it began to loose power and made a high pitch whistle and then shut off. they picked me up and took bike back into shop tore her apart and found the mech. left a rag in lower end, WHAT SHOULD I DO???
That's about all you can do - or expect. They ain't the brightest bulbs in the box.

At the very least you ought to have a dang nice loaner while you're waiting for a (different) tech to do the engine change. And since they've proven they can't be trusted to follow the most basic of good maintenance practices I would be calling everyone at the dealership and HD customer service until the free ESP is in your hands.
Maybe insist that they do a test ride after the replacement and you follow along on the very nice loaner that they give you, since they obviously didn't do one the first time.
Did they at least let you keep the rag for a shop towel to remember your experience by?

They did
