I have a 2008 Softail 96 inch motor, Rush slip ons with Fuel Motto Power Commander 3 and a k&n air filter. The problem Im having is once in awhile after I shut the bike off to fuel up or whatever and restart . I hit the starter button and it acts like the starter tries to engage but makes a aweful sound like its grinding on the starter gear. Any suggestions ?

Original battery? That could be going south along with a whole host of other things. Is the motor stock otherwise? I don't know anything about your PC 3 tuner, but do they make any timing adjustments? I had a generally stock '07 96 and it started pretty good.

Yeah the motor is stock other than what I mentioned, the battery is original and it only does this when its hot.

I've got the same problem with my 2008 Night train. I changed out the battery but was still getting the same thing. Took it over to a bike shop and the guy told me I could have a bad starter clutch.

Five years on a MC battery is a long long time. Change it out. Also check you battery connections and ground connections. I've had several instances where replacing the ground with a "good" ground resolved hot starting conditions.
You don't want to continue grinding the starter ring because eventually it will catch wrong and start eating teeth.
I second the battery change and checking the connections. It takes a little more umph to turn these over when they are hot. I replaced a battery last year after it completely failed me at a gas station after riding for awhile. I took the blame, as it had been telling me for awhile it was gonna fail me on a hot start. I think generally the starters are pretty reliable. I have completely solved my hot start problems with compression releases, but my motor is not stock.

it may have already damaged the ring gr teeth. i had to replace the ring gr on my 07 due to broken teeth. luckily JPcycles now carries a ring gr and starter drive kit for the 07 and up 6spd bikes.
the only way to know for sure if the ring gr is damaged, is to pull the outer primary and look at the ring gr teeth and see if any are missing. they may be gone and when it lines up with the starter drive you get that grinding noise.
I had the same problem when hot the starter would try to start like a dead battery then make a terrible noise and somethimes cough back through the throttle body. I put a new battery Oddesy with hige cranking amps did not help....finally put a screaming eagle compensator in and have never had the problem again. I think the 2008 softails had problems with a compensator....
