That is just **** Poor service and is unacceptable in my book to be treated like that..I would have left the thing parked on a Train track if I knew that no one on the Train would get injured when they hit it..

------ they did a stage 2 huh? how the heck could they have checked their work ( or done any dyno or tuning) with the sensor disconnected- or did they break a retaining clip when they took it off the first time- and stuck it on hoping it would stay.
Name the Dealer- you know why?
This is their opportunity to show the market that when they make a mistake, they make good on it.
OP needs to be clear what he wants for compensation, and to make clear to the dealer that this where they can show that IF an employee makes a mistake, the Dealership as a whole will work to correct the mistake, not compound it by leaving you and your new bike stranded.

One thing for sure; I would NEVER go to that dealer again. Once you get your money back I'd smear 'em all over every forum. Seriously; you break down on the way home with a brand new bike and their answer is too bad!?!? That dealer deserves to not be in business.

Ok, not trying to take up for anybody, but...
I run a wrecker service and do Motor Club calls for ALL of the diffrent Roadside Companies including Road America, that is who Harley is currently contracted with.
I think the problem you ran into with the Dealer not wanting to tke the tow bill is that most Motor Companies, including GM, Will Not reimburse the dealer if if the tow was priced at a higher than what they currently have contracted with their Primary Service Provider. And most Tow Companies charge a preimum to load a bike if they will do it at all.
The Motor Clubs have a hard time finding anybody that is willing to hook a new bike up, You know how picky those Harley guys can be, I am.
On another note, a 2hr ETA is unaccaptable on the Tow Companies part.
The only thing to do in a situation like this is to take care of your SHI*. Bit the bullet and get it towed in a timley manor, Pay the driver and try to get reimbursed later (I did when my 08 Ultra broke the belt with 700 miles, after a 3hr eta). This way you did everything you could to keep the situation from getting worse. Sitting on the side of the road for 2 hours is dangerous and not worth the risk.

Here and in Georgia I think you have 3days to return a new vehicle to the dealer for a refund. I would check and if possible they would have it back. Than again I have been told that I'm a azzhole anyhow. Good luck,must be a real dealership you are dealing with to be a bunch of ****** like that.
I understand what you are saying, but I paid for the upgrade up front when I bought the bike. I made them write the service order seperate and itemized then add it to the bill of sale. I know exactly what it cost. They supposedly ordered the parts. The upgrade has not been done. They have not indicated they will refund the money and I asked for it back in writing. I am not naming the dealer yet because I do not have the money and don't want to make it worse. They are never touching my bike again. And carlgrover summed up how I would like to go forward! (thanks for the laugh Carl)
This sounds more like a dealer problem, if they disconnected the sensor to do the upgrade- it shows lack of work completion.

I don't think I was clear about the way the ERS towing works.
It is like Harley has already paid Road America for 1 tow on every bike they sell. EVERY ONE of them. So they want you to use it (that tow) if you need a tow. Not bring them another, more expensive tow bill to add to what has already been spent on the Roadside Program.
As far as returning the bike as a Lemon or getting $3000 back because a wire was unpluged??? Good Luck.
I know it sucks to have something new break down, but it happens. That is what paid for my StreetGlide

There is no such thing in Illinois or they would have the bike back aready.
