unfortunately if I do that I need to take the exhaust off the bike to get the bracket apart... but it may be my only choice

You could try a dremel and cut the nut off the bolt. My guess is the bolt is stripped though.

UPDATE!!!! I got the nut and bolt off and obviously need a new one of both... Im going to head down to the hardware store and pick up the stuff I need... but the question is.. do I replace the nut with another nylon lock nut or go reg. steel nut and use loctite? Looking at the nut and bolt that came off it does appear that the BOLT stripped and NOt the nut.... even though its tough to tell since the nut is pretty messed up after fighting to get it off... Should I upgrade to grade 8? Sorry for all the dumb questions Im still pretty green with all this stuff... thanks and Cheers!!!

Glad you got it off, I would go with nylon, or stainless with lock washer, no need for blue locktite

I would do what HDDyna2006 said as for the bolt and nut, however I would definitely put some locktite on that bolt. HDDyna2006 What is your reasoning behind NOT putting locktite on it? Are you thinking the the lock washer will handle it ok. Just wondering...why not. I think I would err on the side of overkill...

I was referring to not blue the nylon nut, that's what cause the problem in the 1st place. not against blue the steel washer/bolt.
