The problem is, dipstick, is that there is no proof that he WAS drinking and riding. Carrying an empty beer can is not illegal.

Open container laws, typically, do not apply to rest areas since people DO picnic there.

The problem is that the OP didn't actually break any laws. Holding an empty beer can is not proof of alcohol consumption.

He didn't ride around with an open beer. He rode around with an empty beer can. There is a large difference.

Like was stated earlier, apparently some facilities, such as some parks or rest areas don't have trash cans.
