Why anyone would operate a motor vehicle and drink alcohol (regardless of the amount) is beyond me. Having a beer can in your hand while next to your vehicle is enough to give any cop a reason to look your way. You can be upset all you want, but it seems to me you set yourself up for this.
He didn't have a beer in his hand. Learn to read. He had an empty beer can in his hand that he said that he had with him from a previous stop.

The problem is, dipstick, is that there is no proof that he WAS drinking and riding. Carrying an empty beer can is not illegal.
"Barney" was doing what he thought was taking a drunk off the streets. And it doesn't matter if you had the can from your previous stop or carried it from home - it is still an open container.
Open container laws, in non-designated areas, only apply to containers that have liquid in them, and apply to more than alcohol in most cases.
Open container laws, typically, do not apply to rest areas since people DO picnic there.
What? You think that there's a "brotherhood" here just because we all ride Harleys?? That's pretty naive, don't you think? I don't know OP from Adam and certainly don't consider him a brother. I base my comments & opinions on the person and his/her actions. NOT by the kind of bike he rides. Personally, I wouldn't ride with ANY drinking-&riding law breaker - HD or not.
You sound like one of those guys that would keep riding on past someone that's broke down on the side of the road because you're not his "brother".
What I wonder is why, on this past weekend with the Fourth of July being the biggest time for DUI arrests, did you even consider driving around with an open beer? Also was the problem that the beer was in the park? Most of our parks are posted with no alcohol with out a permit. Just tough that this was the focus of this past weekend and there you were with a flag waving look at me. I don't know (or care at this point) if that beer was you first or twelvth, but caring it on the road in WI can get you in a bind. You now know that.

Still don't understand why someone carries around empty cans on a motorcycle. Everytime I stop and get a drink of pepsi the can or bottle ends up in the trash at the place I bought it..... Also congrats Schumacher on being sober. It good to know that some people still know when enough is enough and things need to change for the better. Hope everything keeps going good your way.
Like was stated earlier, apparently some facilities, such as some parks or rest areas don't have trash cans.
