3:21 today: Contacted MOCO, spoke with Rob, found file # but there was no record of info being faxed from dealer. Contacted dealer, they faexd yesterday morning, even had a fax conferm reciept. Drove out to dealer, got copies of all stuff, explaining that I had believed them, but that this NICE GUY Rob had given me an e-mail address and I had promissed to e-mail him exactly what the dealership had sent. Stay tuned, currently scanning documents - wife calling me to dinner - muuum PEA SOUP!!!
Molsenice...I really appreciate you keeping us informed of how this is going in case any of us have a similar problem. It really sucks that this had to happen but all ya can do is grin and bear it and hope for the best. I had a similar problem as yourself with a Sea Doo I bought back in 2000. I had to fight like hell with Bombardier to get what I wanted, which was a brand new crated engine but after a lot of back and forth, I got it. I always like to say, Dont sweat the small stuff in life. A lot worse could be happening. Hang in there and again, Best of Luck in this endevour.
Holly snot frigin frustration - not with the MOCO - I've been typinng since I finished dinner - 3 hrs ago - yes it was good, however pea soup tends to foul the air around me and I think the letter at a minimum was good therapy.
An update.
I have just finished a three page letter, documenting most of the more frustrating problems I have had with the bike to a lady named Laurie. I wrote it in hopes someone reads it, to let them know where I'm comming from. The service record only tells the story from one side, not the aggrivation or lost opprotunities, nor the "fixs" which never got a service record - SC/AC being relaced for 1. I included pics of the AC and mentioned that the first one is running around loose somewhere on the inside of the machine.
I scanned in and included the service record I got from the dealer - the one they faxed yesterday, but no one at the MOCO could find today.
I e-mailed the letter, the service record and a link to the photos to both the MOCO and myself, just to make sure I had a record of the E-mail going out.
The guys at the dealership said to me that they overnighted gaskets and spacers for the rocker covers, the machine would be running tomorrow afternoon, they think they got it nicked this time - we kinda chuckled nervously, we ( the guys at the dealership and myself) have been there too many times

Lastly, I finish with a question - do I have any grounds to not pick up the bike? - I really do not want to - I'm done as far as I'm concerned - I expect it replaced.
Technically, you own the bike so you are entitled to pick it up. Just because you pick it up does not mean you have to stop your pursuit of a replacement. You can still correspond with HD while the bike is in your posession. I guarantee you they (MOCO) are going to ask the present condition of the bike and if it's rideable and in proper working condition. At that point, you will have to stress your concerns as to why you refuse to ride it. Make sure you stress safety and liabilty as that might make them base their decision on avoiding a future lawsuit if you were to get hurt on the bike because it failed at the wrong time. I'm not sure about this, but it is my belief that HD will not replace the bike until they deem it beyond repair. This is where you might need to start looking into lemon laws in your state. Also, your dealer will most likely have to help you out with the MOCO as well. They obviously will need to tell the MOCO the state of the bike and if they feel it is repaired or damaged so much that it is beyond repair. Hope this helps....
Have you spoken with a lawyer in your area? I know there are some fee's involved but it might be worth it to get a consultation with a consumer lawyer or at least the State Attorney's office regarding your rights under the lemon law if it applies to motorcycles in your state.
one more suggestion, if you don't mind. Go to Radio Shack. Buy an inexpensive machine that will tape your phone calls. Tape all of the ones with the dealer and the MOCO. This little trick not only CYA (since there's no paper trail of phone calls), but it really gets them on their toes.
BTW, You have to tell them that you are taping the phone call. Don't ask their permission. If questioned, just say, I qnat to make sure that I don't get confused or forget something and that I have a back-up of everything you say so that I can review it and make sure that I'm soing my part right.
Warrior - got the point - and yeap, couple suits I can chat up without it costing $$$$ - (notice the extra $) - as far as taping phone calls Ace, it's a good point but I'm not sure I want to go that route just yet - still going to try the flys with honey route (I've got two of those electrified hand-held bug zappers standing by so to speak). If there were any problems on the phone, I was planning on asking them to e-mail me a copy if they had a transcript ( always get that - this call may be recorded to ensure quality service nonsence), or to put that (whatever it is) in writting, so I have a record of it, or I could have them clarify that to my buddy - whose a Lawyer (but I don't want to mention him to the MOCO yet either). I haven't really spent any time in the dealing with big business - I hand power tools to 200 - 6th and 7th graders everyday for the last 16yrs, and some have noticed when I get on a task, I tend to stick around like a bad smell - it's just a smell and it really hasn't done anything, but to get rid of it, you eventually have to pay attention to the source.
Im not sure about in your neck of the woods, but around here, you have to inform the other party you are tapeing the conversation. Just some thing to consider if you do go that route. Good luck.

Does this Rob actually use two b's (Robb) in his name? I had some correspondence with him a few years back and he wrote a letter to me saying that he "almost never" gets any complaints from unhappy customers. Did he, or any of the others act surprised to be hearing of your troubles?

Actually - Yes. In fact when I drove out to the dealership yesterday, under the pretence that I had promised to e-mail exactly what they had faxed, Butch was stating that it was VERY strange that the MOCO had not contacted them concerning the situation. Usually in a situation were the customer calls and has a file opened, the MOCO calles the dealer within an hour - this, according to Butch. I did see the fax, it did have a confermation slip. While talking with Rob(b), he said problems are rare. I would like to agree with him, as I also have another thread going in general harley chat "looking for guidance", where I am fishing for info as to what others have done to remedy machines that do not live up to expectations. - no news as to wether the bike is fixed or not, as it stands, it looks like I will have to pick it up, but not trusting it, I do not have to ride it - I value my life and the odds are it will break down again - possible in a situation or mannor that threatins my well being - stay tuned
