I recently took apart my hand controls to add chrome covers. The right brake switch sits in a groove in the hand control and the small tip of the switch protrudes through and is actuated by the brake lever. It may be that the switch has somehow become misaligns. I suspect though that the switch is bad.
My 05 RKC did that, mostly the brake light just stayed on, it was a bad rear switch. When it first started acting up you could get it to go off by shaking the front brake lever oddly enough.
I just replaced mine...Cost was $9.95 for an aftermarket swtch and about 45 min of work. Do not cut out the entire wiring harness like the directions with the new switch say. Open the housing and find the old switch. You will have to undo a bracket (1 Screw) that holds the switches and wire then when you have a little to work with, Just clip an inch or so below the old switch and cut off the excess the same distance below the new switch. Then, just twist the wires together good and seal each with a piece of shrink tubing. No need for splicers because there is no pressure on these wires the shrink tube is more than sufficient, There is no need for pulling the wire all of the way down past the gas tank. This is how my local mechanic fixes the problem on all bikes that he services. Worked great for me and was quick and easy.
It's not that hard at all...Try getting the switch from a shop with aftermarket parts (mine came from drag specialties)...I wouldn't buy it from the dealer because it will probably cost more. Maybe from a local shop that does some work on harley's. They might even give you a short piece of shrink tube, my mechanic did. Any auto parts store will carry the shrink tubing, if you can't get it from the shop.
I don't believe it is the switch and here is why, I ran into the same problem when I switched out my switch caps and the reason was that there is a copper "wedge" that goes between the end of the brake lever and the housing itself that acts as a shim for the switch. It fell in the bottom of the switch housing when I loosened the housing. My buddy at the parts counter said it happens often when they are working on them and knew exactly what I was talking about when I described what I was doing and the symptoms. The replacement part was less than a dollar (phenomenal for HD I know).
