Same happened to me 5+ weeks ago! Still waiting.
Parts on back order. Maybe just me but I think a new bike or a new motor should be the way it's handled, not a rebuilt refurbish one.
For all of those of you wondering I gave HD the chance to make this right. Not once but three times. They have had their three attempts to fix it but after the last time and a short ride the fluid level was off the stick again. The bike has about 500 miles on it and HD and the HD dealership have put over half of those miles on it. I do not know about the rest of you but I did not buy this bike to be a test case for HD. They now claim that they all do it and transfer is normal. Dealership was told to refill the transmission and return it to the customer.
Did I get upset with them, the last time I did but up until then it was all calmly discussed each time. When talking with the wrench at the dealership who has done all the work on the bike his words were, "I would not want it either". I'm in good standing with the dealership, so my problem is with MoCo and their lack of customer service. The dealership has it's hands tied by MoCo.
I agree Steve to a point... here's why. My dealer sounds like yours as they have called to give updates every step of the way as the test after test to abide by MoCo. Even to tell me I should recieve new motor to this point. The problem lies in service not once told the GM nor Owner who is very involved in day to day operations. The one reason why I bought my bike there! So for 4 weeks no one other than MoCo and service was aware. I have contacted MoCo 8 times now with no provail other than "they need to talk to escalation department". As you said the dealers have there hands tied however they should be the 1st in line to help the customer out. You know as well as I do they have a contact to make it right if they really want to
I own one of each oil cooled and water cooled and they both do it.
This is a design flaw and it will happen to each and every M8 if ridden in the proper conditions.
I own a 17 King. The gear oil didnt migrate when it was dynoed. What conditions are we talking about that wouldnt be met doing a Stage 2 tune with the old super tuner?

Sounds like a class-action lawsuit is in the MoCo's future. It's so typical that they choose not to just Man-Up and take care of their loyal customers, but that's never been their way and never will be.
Visited my dealer today as mine has lost 4 oz of transmission fluid in 90 miles, bikes done 4600 miles now, 600 of those miles is with the stage 3 & I've only just started really opening it up 4 - 4 1/2 K. Up until now no transfer & i have been religiously checking levels, but now its a different storey !! This is their 3rd one now that they know of with this issue, as stated here they said "Harley has not got a clue how to sort this" but they are taking the bike in next week to have a look at it, not sure what they will achieve but I just wanted it documented with them as having this problem. Also having issues with the front brakes now, started pulsing & they said it will be warped rotors & they are not covered under warranty !!
